Before entering into any venture involving property in the City
of Gladstone, check with the Planning and Development Department
to make sure the use you intend to make of the property is allowable
in the use zone which applies to that location.
When the owner of any property in Gladstone proposes to use it
in a manner that is prohibited by the current zoning of that land,
the owner or an authorized representative may apply to have the
zoning changed.
The City Council, upon the recommendation of the City Planning
Commission, is authorized to change the zoning of any property
within the City as long as the action is justified by public necessity
or the general welfare.
A. Submit application and pay filing fee.
Your first step in seeking a rezoning is to obtain a rezoning
application from the Planning and Development office. Submit the
completed application form, along with a legal description of
the property, and your preliminary plans. You will be required
to pay a deposit of $200. (Check payable to City of Gladstone.)
A member of the Planning and Development staff will review your
materials to make sure all necessary items have been furnished,
and will schedule a public hearing to put your application on
the next available City Planning Commission Agenda.
Note: The City Planning Commission meets on the 1st and 3rd Mondays
of each month. Applications must be received before 12 noon on
Thursday, 25 days prior to the meeting at which you would like
to be heard. This delay is due to the required legal advertisements,
time to prepare and mail letters of the hearing to adjacent property
owners, and complete other administrative work.
The property may be posted with a sign stating the requested change
and the time and date of the public hearing.
B. Public Hearing held before Planning Commission.
A public hearing will be held before the City Planning Commission.
You and all owners of property with 185? of the affected site
will be notified of the time, date, and place of the hearing.
You or your representative must be present at this hearing to
present and explain your plan. You should bring with you any maps,
graphs, photos, or any other materials or assistance that you
feel would be helpful in explaining your proposal. At this hearing
any interested parties will be given an opportunity to speak either
in favor of, or in opposition to the proposed rezoning.
At the close of the hearing, the matter may be referred to a subcommittee
of the Planning Commission and a date and time may be set for
an on-site meeting (if applicable).
C. On-site meeting with Zoning Sub-Committee.
An on-site meeting may be held by the subcommittee to view the
site and appraise any problems or special conditions that would
affect the rezoning and should be brought to the attention of
the entire Commission.
This meeting is open to all interested parties and you or your
representative should plan to attend in order to address any questions
that might arise or to supply such additional information that
the subcommittee might require.
D.Sub-Committee report and vote at regular Planning Commission
meeting.
At the next meeting of the City Planning Commission there will
be a report from the sub-committee and discussion of that report.
Following the discussion, a vote of the entire Planning Commission
will be taken to recommend that the City Council approve or deny
the application.
E. Public Hearing held before City Council.
The City Council meets on the 2nd and 4th Monday of each month.
At one of their regular meetings, the City Council will hold a
public hearing on your request. You or your representative should
attend and make your final presentation. At this hearing any interested
parties will be given an opportunity to speak either in favor
of or in opposition to the proposed rezoning.
F. Two readings of ordinance to rezone at regular City Council
meetings.
At this meeting (or the next) the City Council will hear and vote
on the first reading of an ordinance to change the use zone of
the property.
At the same meeting or at the next meeting, the City Council will
vote on the second and final reading of an ordinance to change
the use zone of the property.
If your application was approved at both readings, it then becomes
an ordinance and the use zone for your property is changed.
If your application was denied at any reading, you may, after
60 days, re-submit either the same plan or a modified plan.
From the day you file your application to the day of final approval,
you should plan on a minimum of 6-9 weeks if no complications
or days arise.
